Shahram Sharghy and Helen Pooley settle multi-million-pound brain injury case
Shahram Sharghy and Helen Pooley settled a multi-million-pound brain injury case involving a pillion passenger on a motorcycle who was not wearing a helmet.
The claimant, who cannot be named due to an anonymity order, was riding pillion on a motorcycle without a helmet and in circumstances where the Defendant rider was likely to be under the influence of drugs and alcohol. Contributory negligence, causation and quantum were all in issue and the matter proceeded in the High Court. Despite the disputed issues, the insurer Defendant offered a multi-million-pound settlement based on extremely favourable terms on the issues of contributory negligence, the discount rate and life expectancy. The settlement included significant sums for future professional care, case management and professional deputy costs. The settlement was approved by HHJ Gosnell, the Designated Circuit Judge at Leeds District Registry.
