Tom Little QC successfully defends DPP in high profile judicial review relating to rape cases

Tom Little QC, representing the DPP, appeared in the Divisional Court last week before the President of the Queen’s Bench Division and Lord Justice Singh. The case was listed for an oral permission hearing in a high profile claim brought against the DPP by the End Violence against Women coalition. The claim alleged that the DPP in 2016 changed his policy to make it more difficult to charge suspects of rape and that the CPS were now risk averse in such cases. There were seven public law grounds of challenge, including one that the DPP had adopted an unlawful and subjective bookmakers approach to making charging decisions, which were all dismissed by the Divisional Court following a half day permission hearing.
