The claimant in the case of P v Rusnak  was a car mechanic who suffered an RTA in which both of his legs were fractured. He underwent 28 operations and was still left with non-union of the right leg 5 years after the accident and faced a 15% risk of amputation.
Complex medical evidence and care evidence was obtained. Independently he contracted bowel cancer and underwent an excision operation which affected his life expectation. Andrew Ritchie QC settled the case yesterday for £1,358,000 including a Roberts v Johnston award.
