Chris Stephenson secures settlement for RTA victim

News | Mon 23rd Mar, 2015

Chris Stephenson has secured a significant settlement at a joint settlement meeting for the victim of a tragic accident which had serious consequences for both the victim and the victim’s wife who witnessed the accident first hand.   Mr and Mrs F were walking along a pavement when the Defendant’s parked Landrover ran down a hill and collided with a parked transit van, which was then shunted into Mr F, pinning him against a wall.

Mr F suffered catastrophic limb threatening injuries to his left leg including a severely comminuted open tibial fracture and he developed compartment syndrome.  He required numerous fasciotomies and multiple skin grafts and was left with severely impaired mobility.  Mrs F witnessed the accident and its aftermath and brought a secondary victim claim.  The claim was complicated by the assessment of the care that was provided to Mr F and Mrs F’s loss of earnings.  She had been employed as a nursing manager prior to the accident, but gave up her job to care for Mr F and his father, who lives with them and suffers from dementia.

The claims settled for substantial sums to allow for Mr F’s loss of earnings and care and a sum to reflect Mrs F’s loss of earnings as a result of giving up her job to look after Mr F and his father.

Chris was instructed by James Davies from Irwin Mitchell (Bristol).
