Criminal Injuries Compensation in Excess of £170,000 Secured on Appeal

On 15th September 2021, William Dean represented an injured person before the First-tier Tribunal (Social Entitlement Chamber) on his appeal against a decision of the Criminal Injuries Compensation Authority.

The appellant had been injured in a serious unprovoked attack with a weapon. He suffered a brain injury and lost the ability to work. After a review, the CICA made an offer of compensation of £21,488. On appeal to the Tribunal, further expert assessment was directed and evidence was obtained from consultants in neurology and psychiatry.

William acted for the Appellant at the appeal hearing and argued that a greater sum was merited. He contended for a higher tariff award for the injury itself as well as for lost earnings and special expenses.

After hearing the arguments, the Tribunal made an award of just over £174,000.
