In the appeal by way of case stated Mr Justice Goss agreed with James’ argument resisting the court exercise its power to redefine how it should approach cases when a person obtains money from unlawful conduct and argue for a restriction of the test of forfeiture for regulatory offences contrary to the Environmental Permitting Regulations in light of the case of McDowell and Singh.
Acting as an interested party on behalf of the police James assisted the court in a determination that Bromley Magistrates Court had not acted unlawfully by exercising case management powers to challenge the lawfulness of search warrants, seizure and forfeiture under the Proceeds of Crime Act.”
