Tara represented a Latvian mother in care proceedings brought by a London local authority in relation to her young child removed to foster care at a few months old.
Despite a positive pre-birth assessment of a second child the local authority indicated that they wished to remove the baby at birth. The Mother returned to Latvia and gave birth there. In the meantime and days before the early final hearing was listed the local authority indicated a significant change in care plan to one of adoption, having previously supported the child’s placement in Latvia with a grandparent.
HHJ Ansell agreed that with the parents’ submissions that the Latvian authorities should be invited to accept the transfer of the case to them and the guardian supported further assessment of the mother’s ability to care for both her children in Latvia with the support of her family. A Latvian official attended the hearing and there was every indication that the transfer would be accepted and the assessment conducted.
