Marie McCourt, the mother of Helen McCourt, who was killed by Ian Simms in 1988 is seeking permission to judicially review the decision of the Parole Board to release Ian Simms on the grounds that the incorrect legal test was applied, the decision to release was irrational and the procedure adopted was unfair. The case, listed today and tomorrow, is being heard virtually at a ‘rolled up’ hearing before Macur LJ and Chamberlain J.

It is understood that this case is a legal first in that it is the first case to challenge a Parole Board decision in circumstances where the murderer has refused to reveal the location of the body of his victim.
