Giles reviews the law on informed consent looking in detail at the development of the law leading to Chester v Afshar and Montgomery v Lanarkshire and considers how the law has evolved since Montgomery. Giles also looks at what the future might hold for informed consent and the wider issues still thrown up by Chester.

Breach of Duty in Clinical Negligence Claims

Holly be reviewing developments in the law on breach of duty in clinical negligence claims. She will be exploring recent case law in which the courts have departed from the Bolam test, including a detailed discussion of Muller v Kings College Hospital [2017] EWHC 128. She will identify the alternative tests for breach of duty that have been adopted and address the scenarios in which these should now be applied.
